1. About these terms

This website is operated by We Are Saltbush (ABN 20 476 034 221). Throughout the site, the terms "we", "us" and "our" refer to We Are Saltbush.

By visiting our site, browsing it, joining our waitlist, or purchasing from us, you agree to be bound by these Terms of Service, including any additional terms and policies referenced here or available by hyperlink. These Terms apply to all users of the site.

If you do not agree to these Terms, please do not use this site.

2. Changes to these terms

We may update or replace any part of these Terms by posting updates to this page. It is your responsibility to check this page periodically. Your continued use of the site after changes are posted constitutes acceptance of those changes.

3. Eligibility

You must be at least 18 years of age to purchase from this site or to provide us with your personal information. By using this site, you confirm you are at least 18.

4. Pre-launch and waitlist

Parts of this site may describe products that are not yet available for purchase. Where you join a waitlist or register your interest:

-  You are not placing an order and no contract of sale is formed.

-  No payment is taken and you are under no obligation to purchase.

- Any prices shown are indicative and may change before products become available for sale.

- Any dates or timeframes mentioned are estimates only and are not a promise of availability.

- We may discontinue, change or decline to launch any product described on this site.

Joining a waitlist means you consent to us contacting you about that product. You may unsubscribe at any time.

5. Products and descriptions

We make reasonable efforts to display product colours, materials and dimensions accurately. Colours may appear differently on different screens and minor variations in finish, shade and dimension may occur between production runs.

We reserve the right to modify product specifications, to limit quantities, and to discontinue any product at any time.

6. Pricing

All prices are in Australian dollars and include GST unless stated otherwise. We reserve the right to change prices at any time without notice. We are not liable to you or any third party for any price change.

Shipping costs, where applicable, are additional and will be shown before you complete a purchase.

7. Orders

Where products are available for purchase, your order is an offer to buy. We may accept or decline any order at our discretion, including where a product is unavailable, where there is an error in the price or description, or where we suspect fraud.

If we cancel an order you have paid for, we will refund you in full.

8. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

9. Returns and refunds

Our Refund Policy forms part of these Terms. Please review it before making a purchase.

10. Intended use

Our products are intended for use with domestic dogs under adult supervision. They are not toys and are not intended to be chewed, swallowed or left unattended with an animal. Please follow any instructions supplied with the product.

You are responsible for assessing whether a product is suitable for your animal.

11. Accuracy of information

We are not responsible if information on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions. Any reliance on the material on this site is at your own risk.

We may update content on this site at any time but are under no obligation to do so.

12. Your account and information

If you create an account or provide information to us, you agree to provide current, complete and accurate information. You are responsible for maintaining the confidentiality of your account credentials.

Our Privacy Policy governs how we collect, use and disclose your personal information and forms part of these Terms.

16. Liability

Subject to section 8, and to the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss arising from your use of this site or any product purchased from us.

Where our liability cannot be excluded but can be limited, our liability is limited to, at our option, replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.

You agree to indemnify us against any claim or demand, including reasonable legal costs, made by a third party arising from your breach of these Terms or your violation of any law or the rights of a third party.

18. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force.

19. Governing law

These Terms are governed by the laws of Victoria, Australia. You and We Are Saltbush submit to the non-exclusive jurisdiction of the courts of Victoria.
